Turkish Competition Authority Revises the Commitments of a Food Sector Undertaking for the Year 2025

Upon the application made by an undertaking operating in the food sector, the Competition Board (“Board”) has introduced a revision to the commitments of the relevant undertaking specifically for the year 2025.

According to the revision;

  • The commitments, which became binding with the decision of the Competition Board dated 7 March 2024 and numbered 24-13/218-86, and which cover the 2024–2026 period, remain in force. Under these commitments, the undertaking is obliged to:
    • refrain from purchasing below the intervention reference price,
    • not exceed a total purchase volume of 100,000 tons during the season, and
    • make the minimum purchase determined for the September–December period each year.
  • The obligation of the undertaking to purchase at least 45,000 tons during the September-December period each year has been revised to 30,000 tons exclusively for the year 2025. The revision has been made due to the decrease in yield and quality problems observed during the said period.
  • In its assessment, the Board stated that this temporary revision would preserve the competitive balance in the market, prevent producer grievances, and support the stability of the sector. It was also emphasized that the revision is limited solely to the year 2025, and that the existing commitments will continue to apply in the subsequent periods.
  • The Board stated that, in case of noncompliance with any of the revised or existing commitments, daily administrative fines would be imposed pursuant to Article 17 of Law No. 4054 on the Protection of Competition. It was further noted that this sanction aims to ensure the continued adherence of undertakings that have terminated the investigation through commitments.
