The Turkish DPA Publishes a Public Announcement Regarding the Authorization of Cross-Border Personal Data Transfers through a Non-International Agreement Instrument
The Turkish Data Protection Authority (“DPA”) has published a public announcement (“Public Announcement”) on its official website on 11 November 2025 regarding the authorization of cross-border personal data transfers through a non-international agreement instrument.
According to the Public Announcement:
- Pursuant to Article 9(4)(a) of Law No. 6698 on the Protection of Personal Data, it is regulated that the existence of a non-international agreement concluded between public institutions and organizations or international organizations abroad and public institutions and organizations or professional organizations having the status of a public institution in Türkiye, as well as the authorization of the transfer by the Board, shall be required.
- In this context, the Turkish DPA has authorized the transfer of personal data abroad under Article 11 of the Regulation on the Procedures and Principles Regarding the Transfer of Personal Data Abroad, within the framework of the non-international agreement signed between the Presidency of Migration Management under the Ministry of Interior and the United Nations High Commissioner for Refugees.
