The Personal Data Protection Authority Publishes a Guide on Compliance with the Personal Data Protection Law for Public Institutions

The Personal Data Protection Authority (“Authority”) published the Guide on Compliance with the Personal Data Protection Law for Public Institutions and Organisations and Professional Organisations with Public Institution Status (“Guide”), which was prepared to provide guidance on the compliance processes of public institutions and organisations and professional organisations with public institution status under Personal Data Protection Law No. 6698 (“Law”), on the Authority’s official website on 27 July 2026.

The Guide addresses the following matters in summary:

  • Basic concepts such as personal data, special categories of personal data, data controller, data processor and data transfer are explained.
  • The general principles that public institutions must comply with when processing personal data and the principles for correctly determining the applicable personal data processing conditions are set out.
  • The obligation to inform, ensuring data security, responding to data subject applications, retention and destruction processes, and the obligation to register with VERBIS are explained.
  • The obligations of public institutions to submit information and documents, respond to data subject applications within the prescribed period, and comply with Board decisions during examinations conducted by the Authority are addressed.
  • The legal basis for personal data transfers between public institutions, the principle of proportionality, secure transfer methods, and the technical and administrative measures to be taken are evaluated.
  • Methods for transferring personal data within Türkiye and abroad, as well as frequently encountered practical issues, are discussed.
  • Exceptional cases in which the Law does not apply, either wholly or partially, to public institutions are explained through examples.
