European Commission Sends Notice of Appeal to Adobe
According to the announcement published by the European Commission (“Commission”) on its official website dated 17.11.2023, the Commission expressed its preliminary view that the proposed acquisition of Figma by Adobe could reduce competition in global markets for the supply of interactive product design software and other creative design software.
On 7 August 2023, the Commission opened an investigation to assess Adobe's proposed acquisition of Figma and whether it would affect competition in global markets for the supply of software.
As a result of the enquiry, the Commission came to certain conclusions, according to which;
- It is clear that Figma is by far the market leader and one of Adobe's biggest competitors. The transaction is likely to combine these market positions to create a dominant player.
- Figma currently has a significant restraining influence on Adobe's vector editing tool Adobe Illustrator and raster editing tool Photoshop.
Adobe now has the opportunity to respond to the Commission's Notice of Objection, to consult the Commission's case file, and to request an oral hearing.
The Commission launched an in-depth investigation on 7 August 2023 and has until 5 February 2024 to issue its final decision.
