Commercial Prospecting and Personal Rights: French SA Fines Groupe Canal+ EUR 600.000

On October 12, 2023, the European Data Protection Board (“Board”) released a press release regarding the French SA which fined GROUPE CANAL+ due to complaints of individuals about their commercial prospecting and personal rights.

The French SA determined several aggressions, these are;

  • Non-compliance with the obligation to obtain consent from individuals to receive commercial research by electronic means which is contained in Article L. 34-5 of the French Postal and Electronic Communications Code (CPCE) and Article 7 of the GDPR)
  • Failing of the duty to provide knowledge (Articles 13 and 14 of the GDPR) and to respect the use of rights (Articles 12 and 15 of GDPR)
  • Not providing a contractual framework for the cooperation for the processing carried out by a processor (Article 28.3 of the RGPD)
  • Not providing secure of personal data (Article 32 of the GDPR)
  • Failure to observe the reporting requirement to notify CNIL of a data breach (Art. 33 GDPR)

As a consequence, the French SA decided to EUR 600,000 fine on GROUPE CANAL+.
