JUDICIAL TIME LIMITATIONS AND PAYMENT OF WORKPLACE RENTS HAVE BEEN SUSPENDED WITH THE AMENDMENT LAW

“The Law no 7276 on the Amendments to Certain Laws” (“Amendment Law”) has been published on the Official Gazette numbered 31080, dated on 26.03.2020 (Bis 1).
According to the temporary provisional 1 of the Amendment Law, because of the Covid-19 epidemic, all time limitations including the time stipulated under the Code of Civil Procedure no 6100, Code of Criminal Procedure no 5271 and Code of Administrative Jurisdiction Procedures Law no 2577 have been suspended from 13.03.2020 until 30.04.2020, in order to prevent any loss of rights. In addition to this the time stipulated by the Bankruptcy and Enforcement Law No 2004 also has been suspended from 22.03.2020 until 30.04.2020.
The period of limitations regarding the crime and criminal sanctions, administrative sanctions, preventive detention is not in the scope of the Amendment Law.
The authorisation of taking measures regarding suspension of the hearings is given to the Supreme Council of Judges and Prosecutors (“HSK”) and Supreme Court of Appeal (“Yargıtay”) depending on the subject.
Moreover, under the provisional article 2, the non-payment of the rent for workplaces shall not be reason of termination of lease agreement in the period between 01.03.2020 and 30.06.2020.
